Terms of service

 

Definitions: 

"Company" refers to Prestige Web Studio. "Client" refers to the individual or entity engaging our services. "Project" refers to the web development work agreed upon.


Services: 

The Company agrees to provide web development services as outlined in the project proposal and agreed upon by both parties.


Project Scope:

  1. The scope of work will be clearly defined in a separate project proposal or statement of work. 
  2. Any changes to the agreed-upon scope may result in additional costs and extended timelines.


Payment Terms:

  1. Payment must be received in full before any work starts or the project resumes. Alternatively, a non-refundable deposit of 50% of the total project cost is required before work commences. 
  2. If the deposit option is chosen, the remaining balance is due upon project completion, prior to the website going live. 
  3. Late payments will incur a 5% fee per month on the outstanding balance. 
  4. All payments are non-refundable.


No Refund Policy:

  1. All payments made to the Company are non-refundable.
  2. In the event of project cancellation, the Client is responsible for payment of the full amount agreed upon in the initial contract, regardless of the work completed.


Project Timeline:

  1. Estimated completion dates are provided in good faith but are not guaranteed. 
  2. Delays caused by the Client (e.g., late provision of content) may extend the project timeline.


Client Responsibilities:

  1. The Client agrees to provide all necessary content, images, and information in a timely manner. 
  2. The Client is responsible for obtaining proper licenses for all provided materials. 
  3. Delays in providing required materials may result in project delays and additional costs.


Communication:

  1. The Company will provide regular project updates via email or a designated project management system. 
  2. The Client agrees to respond to communications within 3 business days. 
  3. Lack of response from the Client for over 14 days may result in project suspension.


Revisions and Amendments:

  1. The project includes two rounds of revisions after the initial design presentation. 
  2. Additional revisions or major changes will be billed at the Company's standard hourly rate. 
  3. The Client has 7 days after each milestone to request revisions. 
  4. Once a milestone or element has been approved by the Client, any subsequent requests for changes or revisions to that approved work will be considered out of scope and subject to additional charges. 
  5. The Company reserves the right to refuse any revision requests that significantly alter the agreed-upon project scope or design direction. 
  6. The Client acknowledges that design and development decisions made and approved during the project process are final, and reopening these decisions may result in additional costs and timeline extensions.


Intellectual Property:

  1. The Client retains ownership of all content provided. 
  2. The Company retains ownership of all code and design elements until final payment is received. 
  3. Upon full payment, the Client receives a license to use the final website.


Confidentiality: 

Both parties agree to keep all project-related information confidential.


Portfolio Rights: 

The Company reserves the right to display the completed project in its portfolio unless otherwise agreed upon.


Hosting and Maintenance:

  1. The Company is not responsible for hosting unless explicitly agreed upon. 
  2. Ongoing maintenance and updates are not included in the initial project scope. 
  3. The Client may purchase maintenance packages for an additional monthly fee. Details of these packages will be provided separately.


Browser Compatibility:

The website will be optimized for the latest versions of major browsers at the time of development.


Third-Party Services:

  1. The Company may use third-party services or plugins in development. 
  2. The Client is responsible for any associated licensing fees after the handover.


Termination:

  1. The Client may terminate the agreement with 30 days' written notice. 
  2. In the event of termination by the Client, the Client is responsible for payment of the full amount agreed upon in the initial contract, regardless of the work completed.
  3. The Company reserves the right to terminate the agreement if the Client breaches these terms and conditions.


Liability:

  1. The Company's liability is limited to the total amount paid for the project. 
  2. The Company is not liable for any consequential damages or lost profits.


Force Majeure:

Neither party is liable for delays caused by circumstances beyond reasonable control.


Severability:

If any provision of these terms is found to be unenforceable, the remaining provisions will remain in effect.


By engaging our services, the Client agrees to these terms and conditions.
